Helping a landlord comply with his responsibilities on ending a tenancy

Barry, a registered landlord, contacted Landlord Advice as he was having problems with his rental property.  

The tenant had fallen into arrears, and Barry had issued a notice to quit that was due to expire. However, Barry was concerned because the tenant had not shown signs of moving on.  

He then received reports from the tenant's neighbours about some antisocial behaviour issues.  

Our adviser gave Barry detailed advice on his options and how to ensure he was abiding by his responsibilities as a landlord. He would have to allow the tenant the opportunity to comply with the notice period, which had yet to expire. We also gave him advice on: 

  • the correct legal process to follow to get vacant possession of the property when a notice period has expired and a tenant hasn’t moved out  
  • options to recover any financial loss as a consequence of the rent arrears and damage caused to the property 

We then sign-posted Barry to our Housing Mediation Service to try to resolve any disagreement that might have arisen if the tenant had not given up vacant possession.
